CONDITIONS FOR SCOOTER RENTAL

 

The parties agree and stipulate that the rental will be governed by the following AGREEMENTS AND CONDITIONS:

1 ASSIGNMENT OF THE MOTORCYCLE-The motor vehicle in question is entrusted to the customer, provided with the standard equipment and the circulation documents, who becomes the keeper for all purposes of the law. Driving the motor vehicle is allowed only if in possession of a valid driving license (A1 or B). The motor vehicle is entrusted to the customer on the assumption that the same makes use of it by driving it personally. The customer, therefore, assumes all risk and responsibility in case of entrusting the driving of the motor vehicle to third parties.
2 MOTORCYCLE CIRCULATION - The customer is authorized to travel only and exclusively in Sicily and is responsible for the normal circulation of the vehicle as well as for its correct use. In case of need for roadside assistance, the customer can contact EURORENT SCOOTER. The customer must reimburse EURORENT SCOOTER for the payment of any penalties or fines resulting from infringements of the Highway Code imposed during the period of entrusting the motor vehicle. The customer undertakes to transmit to EURORENT SCOOTER any report notified by the public authority within 24 hours.

3 CONDITIONS OF USE: The customer acknowledges that he does not have any real rights over the rented vehicle and the accessories supplied and therefore cannot dispose of them in any way. In particular, it is strictly forbidden to sub-rent the motor vehicle to third parties in any form. Furthermore, the customer may in no case use or allow the motor vehicle to be used: (a) for the transport of people and / or things for commercial purposes; (b) to push or tow other vehicles or trailers; (c) under the influence of alcohol, drugs, hallucinogens, narcotics, barbiturates, intoxicants or any other substance that may alter the state of consciousness and alertness, or the ability to react, in violation of road traffic regulations; (d) by a person other than the customer.

Furthermore, the customer assumes the obligation to: (a) drive the motorcycle personally and keep it, together with the accessories supplied with the utmost diligence and in compliance with all forms of law; (b) guarantee the safety and functioning of the motor vehicle during the rental period; (c) to indemnify EURORENT SCOOTER from any claim made by third parties for damage suffered by the latter to the goods transported in the rented motor vehicle or due to breakdowns or inconveniences to the motor vehicle; (d) return the motorcycle with the same level of fuel with which it was delivered to the customer.

4 RULES OF THE CURRENT ITALIAN ROAD CODE - The customer declares to be aware of the rules of the current Highway Code, with particular reference to the legislative discipline on helmets, speed limits and the relevant consequences of their non-compliance. Therefore he undertakes to drive the motor vehicle and to transport the passenger with an approved helmet worn.

5 SECURITY DEPOSIT - The Renter customer pays the EURO RENT SCOOTER company at the same time as signing this contract, the sum of € .........., as a security deposit, a sum that will be returned to the Customer upon return of the vehicle, once ascertained the absence of defects or damage caused, either directly to the customer if paid in cash or automatically released after a period of 15-20 days if held by credit card with pre-authorization procedure.
The deposit may be used in whole or in part to cover any damage caused during the rental period with the addition of the expense for the damage appraisal. The deposit can be used to support any costs of losing keys / helmet / vehicle documents or to cover damage to third parties. Failure to pay the deposit will result in the termination of the contract.

6 MOTOR VEHICLE INSURANCE COVER - the rented motor vehicle is covered by civil liability insurance (RCA), which covers damage caused by third parties. In the event of theft or fire, the customer undertakes to report the fact to the competent authority and to deliver the original of the report to EURORENT SCOOTER within and no later than 24 hours from the fact.

7 SINI5TRI - If any accident occurs, the customer undertakes to immediately notify EURORENT SCOOTER by telephone. The customer must request the intervention of the competent authority and, when necessary, must submit a complaint to the competent authority.

8 RETURN OF THE MOTORCYCLE - The date and time of return of the motor vehicle have been agreed between the parties, before the start of the rental, and the customer undertakes personally to respect what has been agreed. The return of the motor vehicle after the established return time will have a penalty of 5 euros / hour. EURORENT SCOOTER reserves the right to terminate the contract and to regain possession of the vehicle at any time in case of violation of the agreed conditions of use.

9 LIABILITY FOR CUSTOMER DAMAGES - The customer undertakes to return the motor vehicle and its equipment in the same delivery conditions and therefore undertakes to make up for any shortages and compensate for all damage caused, except for normal wear and tear. In particular, the customer assumes the obligation to compensate for damages deriving from refueling with fuel other than that provided for the rented motor vehicle. In the event of a tire puncture, the customer is obliged to repair / replace the damaged tires.

10 PENALTIES - Failure to return the keys of the motor vehicle or the Vehicle Registration Book, even if due to loss or theft, will result in a penalty of € 300.00 for compensation. Failure to return the vehicle on the date and time agreed in this contract will result in the illegality of the customer's possession and also oblige the customer to pay a penalty, for each day or part of the day, equal to the sum of the daily rental increased by 20 %, until the moment in which EURORENT SCOOTER regains possession of the vehicle.

11 CONTRACTUAL MODIFICATIONS - Any modification to this contract cannot take place.

12 ELECTION OF DOMICILE FOR THE PURPOSE OF THIS CONTRACT - The customer declares and self-certifies under his own responsibility that the residential address indicated in the attached photocopy documentation is correct, and that for the purposes of this contract any communication or notification may take place at that address , except for modifications to be communicated in writing by the customer directly to EURORENT SCOOTER.

13 This rental agreement is governed by Italian law. All disputes that may arise in relation to the validity, interpretation, execution or termination of the present contract, will be devolved to the exclusive jurisdiction of the Court of Trapani.

14 JOINT OBLIGATIONS - Whoever signs this contract in the name of another person or company, will respond personally and solidly with his / her representative for the obligations assumed towards EURORENT SCOOTER. The original of this contract is retained by EURORENT SCOOTER and a copy is issued to the customer.
